Caldicott Guardians National Annual Conference: Speaker News & Updates

The fifth national Caldicott Guardians Conference took place today in London at the De Vere West One Conference Centre. chaired by and produced in association with Christopher Fincken, Former Chair 2012 - 2017, The UK Caldicott Guardian Council, the day included a welcome introduction from incoming UK Caldicott Guardian Council Chair Dr Christopher Bunch. The conference aims to bring current and aspiring Caldicott Guardians together to understand current issues and the national context, and to debate and discuss key issues and areas they are facing in practice.

Welcome and Opening from the New Caldicott Guardian Council Chair

Dr Chris Bunch emphasised that the UK Caldicott Council is "here to support you". 

Priorities for the Council include:

- improving communication and support

- developing regional links and networks

- strengthening the council

- developing a library of Caldicott case studies

- support for Caldicott Guardians in local authorities and small organisations

Christopher encouraged delegates to ensure they are on the email list for updates and to join local Caldicott Guardian Networks.

Dame Fiona discussed the role of the National Data Guardian. Dame Fiona said the overwhelming theme of this role has been the trust of the public so people can trust that their information is held securely and used properly. 

With regard to the events at the weekend Dame Fiona referenced a letter sent from herself and David Beard back in May 2016 to all provider trusts that discussed actions and recommendations with regard to data security. Leadership Obligation 3: Technology: Ensure technology is secure and up-to-date. (July 2016)

-No unsupported operating systems, software or internet browsers are used within the IT estate.

-A strategy is in place for protecting IT systems from cyber threats which is based on a proven cyber security framework such as Cyber Essentials. This is reviewed at least annually.

-IT suppliers are held accountable via contracts for protecting the personal confidential data they process and meeting the National Data Guardian’s Data Security Standards.

Timeline following consultation and review

-Government accepted recommendations in principle, subject to consultation
-Formal public consultation ran July to September 2016

- Department of Health undertook further consultation and discussion with stakeholders 
- Pre-election restrictions prevent publication before the election of  Government response to the consultation 

Dame Fiona discussed putting the role of the National Data Guardian on a statuatory basis - to ensure the role has the authority behind it. Due to issues around the election the bill is now waiting.

Stacey Egerton’s Biography:

Stacey joined the Information Commissioners Office in 2012 and is currently a Senior Policy Officer within the ICO’s Strategic Liaison - Public Services Team. She provides advice and support to a range of organisations in the health, education and local authority sectors regarding information rights and data privacy.

Stacey has responsibility for some of the teams work around multi agency data sharing including, integrated health and social care, troubled families and devolution. She has provided advice to numerous stakeholders around developing data sharing agreements and privacy impact assessments in relation to these initiatives.

Before joining the ICO, Stacey completed a Law degree and worked in the public sector and then as a family law advisor and paralegal.

Extended Interactive Session: A Manual for Caldicott Guardians: improving consistency in practice

This extended session focused on the recently-published manual for Caldicott Guardians, and covered the role and competences required.

Christopher discussed the role, responsibilities and competency development.

Christopher Fincken, Former Chair 2012-2017, UK Caldicott Guardian Council

This extended session worked through Case Histories in practice – using real case study examples to demonstrate the complexities of Caldicott decision making and tools and techniques to help you in practice. The session also included a focus on domestic violence and sharing of information.

Christopher Fincken’s Biography:

Christopher Fincken is an independent member of the UK Council of Caldicott Guardians (UKCCG) and was its Chairman from 2012-2017, working closely with the office of the National Data Guardian. He is currently involved in several collaborative initiatives, including working with the Information Governance Alliance, the Centre of Excellence for Information Sharing, The Home Office and the Police.

He was a Caldicott Guardian for over ten years in an Acute NHS Hospital Trust serving a cathedral city and large rural population before volunteering as a Caldicott Guardian for Marie Curie, the leading UK charity which provides home nursing care and hospice care for people with a terminal illness.

Adrian Marchbank Biography:

Adrian is a consultant cardiothoracic surgeon in a teaching hospital and a Lecturer at the Plymouth University Medical School. He is lead for thoracic data collection and audit. In May 2012 Adrian was appointed Caldicott Guardian for the Plymouth Hospitals NHS Trust, and in April 2015 was co-opted onto the UK Council of Caldicott Guardians.

Gill Weatherill Biography:

Gill Weatherill is a partner in the Healthcare Regulatory team at the law firm DAC Beachcroft LLP and has 17 years of experience in advising health and social care providers. She is also a visiting lecturer at Northumbria University on the medical and mental health law LLM courses. She works closely with NHS and independent sector health and social care providers, and sits on the medical ethics committee at City Hospitals Sunderland NHSFT. She has extensive experience of advising acute and mental health trusts on complex issues of capacity and consent to treatment, and has represented acute and mental health providers in high profile Court of Protection and High Court proceedings. She has also represented providers in a wide range of inquests, including prison deaths and other jury inquests.
