Sally who is now the Safeguarding Lead for the Care Quality Commission discussed the CQC role in safeguarding and the new inspection process.

Sally discussed the safeguarding challenges from the early waves of the new inspection process which include:

A need for greater understanding of the Deprivation of Liberty Safeguards

o   Concerns that some providers still fail to understand when and how to use the safeguards

o   Also that medical professionals may not understand when or how to trigger the assessment process

Hospitals generally under reporting of safeguarding incidents

Given the size of the NHS DBS would expect to have 800+ referrals – they have 350+

When CQC receives information with safeguarding implications, it has a responsibility to pass on this information and assess its impact on provider compliance.

Sally said that the primary responsibility to make a safeguarding referral lies with the provider and to ask the right questions about quality and safety including:

Safe?

Effective?

Caring?

Responsive to people’s needs?

Well-led?

When CQC identifies potential abuse they are to inform the provider / manager of the service unless they are directly implicated and ensure immediate action is taken to protect the individual/s from harm, if safe to do so. Then to ensure a timely safeguarding referral is made to Local Authority and/or police within 24 hours of the incident.
