UK Government: Mental Health Bill Receives Royal Assent

This new Mental Health Act 2025 is designed to bring mental health law into the 21st century by improving protections, increasing patient autonomy, and strengthening personalised care for people with severe mental illness. It reforms outdated parts of the Mental Health Act 1983 to better reflect modern clinical practice and human-rights standards. 

Under the new Act, people detained under mental health law are expected to have more say over their treatment, with statutory care and treatment plans and earlier involvement of families or nominated supporters in decision-making. Ministers say this change marks a shift towards care that respects dignity and choice. 

The legislation also aims to tackle disparities in detention rates, which have disproportionately affected racialised communities, and remove prisons as designated “places of safety,” ensuring individuals in crisis are supported in appropriate healthcare settings. 

Health leaders and campaigners have welcomed the Act as a step forward for mental health rights, noting its emphasis on patient voice, therapeutic benefit and least-restrictive care. However, some advocacy groups highlight that effective implementation will depend on investment in community support services before key reforms take full effect. 

The new law is now in place, with detailed guidance and phased implementation expected over the coming months as the Government works with the NHS and mental health organisations to bring its provisions into practice.
